Advance Directives

Once it is signed and witnessed, Advance Directives is a legal document in the state of New York . It is similar to the Living Will, however the Advanced Directive is the only document that gives an individual a say in their own mental health treatment. Make sure you get an Advance Directive created for New York State residents, as the laws are different in each state.

This is a very powerful document. It lets you inform hospital staff, psychologist, psychiatrist, medical person, and physicians:

  • What hospital you prefer in a non-emergency situation
  • What medications you prefer
  • What medications you do not want to take
  • What helps you get better quicker
  • What doesn’t help you
  • What treatments you would like to try and which would you not want
  • What medical conditions you may have - please include documentation. Once you have attached documentation to the Advance Directive, it becomes part of your legal document.
  • Combines Living Will and Mental Health Treatment preferences all in one document.

Who would benefit from using an Advance Directive?

  • Client of mental health services who may be hospitalized in a Behavioral Health Unit
  • Client of mental health services who is a single parent and maybe placed in a Behavioral Health Unit. This document lets Family Court know that you have made plans for your child(ren)'s care and well being while you are hospitalized.
  • Client of mental health services who is at least 16 years of age and maybe placed in a Behavioral Health. It would not be a legal document; however, you would be giving the hospital a lot of information about you to help you get out sooner.
